Terms & Conditions

By creating an account or using ImageLablr (“Service”, “Platform”, “we”, “us”, or “our”), you agree to these Terms and Conditions and our Privacy Policy. These terms apply to all users including administrators, field technicians, and any other role within an organization. We reserve the right to update these terms at any time with notice provided via email or within the platform.

ImageLablr is a web-based platform that provides AI-powered photo labeling, organization, damage detection, and report generation tools for insurance professionals. Key features include:

• Uploading, storing, and organizing job site photos in structured folders by section (Roof, Elevations, Interior, Other Structures)
• AI-powered damage detection and photo labeling using OpenAI GPT-4o Vision
• Generating downloadable ZIP archives with labeled photo filenames ready for Xactimate, Symbility, and other claim platforms
• Scope note and narrative generation for insurance reports
• Team management with role-based access control (Admin, Field Tech)
• Report builder for organizing photos into sections and generating PDF reports

Photos uploaded to ImageLablr are stored securely in Amazon Web Services (AWS) S3 infrastructure. By uploading photos, you agree to the following storage policies:

• Active Storage (S3 Standard): All uploaded photos are initially stored in AWS S3 Standard storage in the us-east-2 (Ohio) region, providing high-durability (99.999999999%), low-latency access for active jobs.
• Automatic Archival (Glacier Instant Retrieval): Photos associated with jobs that have been inactive for more than 90 days are automatically transitioned to AWS S3 Glacier Instant Retrieval storage. This reduces storage costs while maintaining millisecond-latency retrieval. You can access and download archived photos at any time at no additional fee within your plan.
• Deep Archive (Optional): For jobs inactive more than 9 months, storage may be further transitioned to AWS S3 Glacier Deep Archive. Retrieval of deep-archived photos may take up to 12 hours. You will be notified before any deep archival occurs.
• Photo Limits: Each plan includes a monthly limit on photos uploaded and total active storage. Individual photos are typically 1–10 MB each depending on device and resolution. Exceeding plan limits will prompt an upgrade or require deletion of older jobs.
• Deletion: When a job is permanently deleted by the user, all associated photos are queued for permanent removal from AWS S3. This process completes within 24 hours and cannot be undone. Photos deleted from a report section are removed from the report only — the original photo remains in the job.
• Account Termination: Upon account termination or cancellation, all photos and job data are retained for 30 days to allow export, then permanently deleted.
• Ownership: You retain full ownership of all photos and data you upload to ImageLablr. We do not claim any intellectual property rights over your content. We will never share, sell, or use your photos for any purpose other than providing the Service.

ImageLablr uses OpenAI’s GPT-4o Vision model to analyze photos for damage detection, classification, and label generation. By using AI features, you acknowledge and agree to the following:

• Photos submitted for AI analysis are transmitted to OpenAI’s API servers for processing. OpenAI’s data usage policies apply to any data sent through their API.
• AI-generated labels, damage classifications, severity scores, and scope notes are suggestions only and do not constitute professional engineering, appraisal, or insurance opinions.
• AI results must be reviewed and verified by a qualified insurance professional before inclusion in any official claim, report, or legal document.
• Each AI photo analysis consumes one (1) credit from your account balance. Credits are non-refundable once consumed.
• ImageLablr is not responsible for inaccurate AI classifications, mislabeled photos, or incorrect damage assessments. Users assume full responsibility for verifying AI outputs.
• Generated filenames (e.g., Front-Elevation-Hail-001.jpg) are based on the AI label and user-assigned section. These names are for organizational convenience only.

You are responsible for maintaining the security of your account credentials. You agree to:

• Keep your password confidential and not share account access with unauthorized individuals
• Immediately notify us at support@imagelablr.com of any suspected unauthorized account use
• Ensure all team members you invite to your organization comply with these Terms
• Use strong, unique passwords and enable multi-factor authentication where available

Account authentication is handled by Clerk, Inc. Their privacy policy and terms govern the handling of authentication credentials. ImageLablr does not store passwords.

Organization accounts can invite team members. The following conditions apply:

• Seat Limits: The number of team members is limited by your plan tier. Exceeding seat limits requires a plan upgrade before additional members can be invited.
• Admin Responsibility: Organization admins are responsible for all activity, content, and conduct within their organization on the platform.
• Role-Based Access: Admins control job access for Field Techs. Field Techs can only access jobs dispatched to them. Admins have full access to all organization jobs.
• Member Removal: Removing a team member revokes their platform access immediately. Their uploaded photos remain associated with the organization’s jobs.
• We reserve the right to suspend organizations that violate these Terms without prior notice.

You agree not to use ImageLablr to:

• Upload photos or content that is illegal, defamatory, or violates any third-party rights
• Fabricate, alter, or misrepresent damage photos for fraudulent insurance claims
• Attempt to reverse engineer, scrape, or abuse the platform’s APIs or infrastructure
• Circumvent plan limits, storage quotas, or seat restrictions through fraudulent means
• Share account credentials with individuals outside your licensed organization
• Use automated bots or scripts to upload photos or generate reports in bulk without authorization

Violation of acceptable use policies may result in immediate account suspension without refund. Suspected fraud involving insurance claims will be reported to applicable authorities.

Subscription plans are billed monthly or annually. By subscribing, you authorize us to charge your payment method on a recurring basis until cancelled.

• Monthly Plans: No refunds for partial months. Cancel any time to stop future charges.
• Annual Plans: Refunds available within 14 days of the annual billing date for unused portions, prorated.
• AI Credits: Credit packs are non-refundable once purchased. Unused credits expire 12 months after purchase.
• Downgrades: Plan downgrades take effect at the end of the current billing period. Data exceeding the new plan’s limits must be reduced before the downgrade date.
• Failed Payments: Failed payments may result in service interruption. We will attempt to notify you before suspending access.

All platform code, design, UI elements, AI models, and branding (including the ImageLablr name and logo) are the intellectual property of ImageLablr and its licensors. You may not copy, modify, distribute, or create derivative works based on the platform without explicit written permission.

You retain all rights to the photos and content you upload. By uploading content, you grant ImageLablr a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you.

ImageLablr is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the platform, including but not limited to:

• Loss of photo data due to accidental deletion or storage failure
• Business interruption or loss of claim revenue
• Errors in AI-generated labels, damage assessments, or scope narratives
• Unauthorized access to your account by third parties

Our total aggregate liability to you shall not exceed the total amount paid by you to ImageLablr in the twelve (12) months preceding the claim.

Your use of ImageLablr is subject to our Privacy Policy, incorporated into these Terms by reference. Key points:

• We collect only the data necessary to provide the Service (account info, job data, photos, usage analytics)
• We do not sell your personal data or photo content to third parties
• Photos are transmitted to OpenAI only when you explicitly run AI analysis on them
• We use industry-standard encryption in transit (TLS 1.2+) and at rest (AES-256 on S3)

You may cancel your account at any time from the Settings page. Cancellation stops future billing. Your data is retained for 30 days post-cancellation to allow photo export, after which it is permanently deleted.

We reserve the right to terminate or suspend accounts that violate these Terms, engage in fraudulent activity, or abuse platform resources — with or without prior notice depending on severity.

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding shall be brought exclusively in the federal or state courts located in Bexar County, Texas, and you consent to personal jurisdiction in those courts.
